yes, 485 processing and 140 processing is different. They are joined thread, So they will not approve 485 until your 140 is approved.
Thanks Marphad. BTW, do you have any idea what could they possibly ask for 485. I provided everything they've asked for when I first filed the case. If not, I guess I'll find out in a few days.....

Hi,
My wife has FP appointment scheduled for 12/29/07, She is in india now. I have returned from india today only(12/28) and saw the FP appointment. Can i reschedule FP one day before the appointment date? If i send the reschedule request today will USCIS accept it? since there is only one day left. Please advice me.

My understanding is that you can transfer existing H1B. I am not a lawyer.If you have a copy of your H1B approval notice, you should be able to transfer to your new company. However, if you may have to visit US consulate back in your home country for Visa. You may want to double check with immigration gurus.

Hi guys,
I am new to this forum. I am a recruiter and I have a candidate for a position in the US who is close to getting an offer. Here is my situation, any help would be appreciated.
Candidate is a Canadian Citizen currently in the US working with TN (Nafta Visa)
He has renewed his TN 4 times.
He is now close to receiving an offer from my client, but his current company just filed his petition for a H1B visa.
Not sure what is best for him and new employer. Candidate just received an email from his HR that he can't travel during petition, but would the new job, he will need to go to Israel for training. Can he make a request to his current employer to withdraw his petition once he decides to change companies in order to do TN visa again?
Any help would me much appreciated.

a. Hospital birth records which name the child and both parents.
b. Medical records which name the child and both parents.
c. School records which name the child and both parents.
d. Census records which name the child and both parents.

Religious records in the form of a certificate under the seal of the organization where the baptism, dedication, presentation or comparable rite occurred following the birth, showing the date and place of the child�s birth, the date of the religious ceremony, and the names of the child�s parents.
I have submitted Date of Birth Certificate at the time of applying 485 which is dated in 2002.
Ans:
I am planning to submit notarized affidavits from my father and mother.
SSC (10TH Certificate/Memo)
Are these enough? What are the other options ? Please let me know your valuable thoughts..

Hi,
I got an RFE on EAD Renewal and notice says the following.
The application you submitted must bear the original signature of the applicant. You must sign the attached copy of Form I-765 in the signature block marked in Red.
I got only RFE notice with this information and there is no attachment with this RFE.
I am 200% sure that I signed the application.
Now I have no idea what to do and there is no attachment to sign.
I filed myself without attorney help.
Any one please help me how to handle this RFE.
Can I send new I-765 application or request again for attachment

You might have signed using a black ink. Now-a-days, the photocopiers are so cool, you can not differentiate between original and a copy. It could be one of the reason, USCIS has sent an RFE on your EAD. Write a cover letter, Fill a new 765 form with the same details as the one you last sent and Remember to sign in BLUE ink.

The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. As you will have a valid H4, you can try using H4 at the port of entry but it doesn't matter even if you use AP. If the Officer at the PoE objects or raise questions pertaining to your work status then you might want to use AP. Your status will not affect your spouse (or entire family) Green Card process.
Your status depends on your spouse's status. If your spouse is on H1B; you can always convert your status to H4 even if you use AP at the port of entry.

I think you qualify for expedite criteria since not getting EAD will force you to stop working and cause severe financial hardship.

You can certainly file for EB-1 or EB-2 based on the job discription. You will need to file new LC/ I-140 in the respective category and once approved you can port your earlier PD.

5. My passport expires in the middle of 2010.
Based on this, in order to ensure my legal stay in the United States, do I need to do anything, except renew my passport at some point of time before it expires, in terms of either having to leave the US, or go to some agency to update something? Please suggest. Thank you for your help.

My wife is on H4 and she got her EAD yesterday. She wants to work on EAD.
She doesnt have valid visa in her passport, we are planning for India trip soon and also planning to go to US embassy for stamping as our visa got expired.
My questions are
1. Can my wife apply for a visa after she starts using EAD? and later can she extend her H4 along with my H1 extension which I'm going to apply mid next year?
2.Is it ok to travel just on AP for her if she doesnt want to apply visa?
Please suggest.

I filed I-485 on October 1st. Alone with I-485 I filed Form G-1145, E-Notification of Application/Petition Acceptance. Instructions for G-1145 says that I will be notified within 24 hours of documents accepting but I didn't get any notification yet. Is this something I should worry about? Documents been sent by Express mail and delivered to Chicago lockbox on October 1st.
