I am having my EAD and AP and I am not using my EAD.

EAD expires Sept 08
AP expires Oct 08

My question is

Can I renew AP only ?
If, I do not renew EAD will it be a problem in the future ?
Can I renew it after EAD has expired ?

Also, If I am renewing AP only, when does the 120 days rule come into picture.
Is it with the AP date or EAD date.

Your input will be appreciated.

As far as i know, it dosent matter if you are on EAD or H1b. You can open a bussiness as a investor. You can have profit of that business but you can not generate your payrole or you can not work for that particular business. I will recommend to assist immigration lawyer or CPA.

If you have a job, getting a work permit will take only 4 hrs inside the consulate. No line. Give the passport and come back within 4 hrs to collect it.
No labor certification for computer(s/w for sure, dunno about h/w side for sure) professionals or petition. Need to show offer letter from the company and letter from company to the consulate.

I have filed I-485 as derivative on my spouse case with his PD of EB3 Dec2005 as his I-140 was also approved in july 2007. I have AP/EAD through it, but have never used them.

I am currently on H1B and just got my I-140 approved through my employer in EB2. My priority is Feb 2005 which is much earlier than his EB3 Dec 2005. The approved I140 has the same Alien # that I received through my pending AOS case filed earlier in july 2007..

Do you recommend filing I-485 again based on August bulletin now that my PD is current.

How does processing date working in tandem with Priority Date.

What is your take on multiple I-485 filing.

with 90 days validity and I have not seen my receipts or checks cashed yet.

My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.

Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.

And there is nothing one can do about it, so i am thinking it will be alright.

We will be fine.
