We still in negotiation. not come to a stage where EAD has been asked for. i am wondering what else could they ask for other than EAD like do they need to provide any proof that they will sponsor my green card or do i need to file AC21 in advance.
It all depends on Company. Most of the companies they just see EAD and take you.
If that company has dedicated IMM people and IMM knowledge they might ask you for more information and they just want to make sure they don't need to support you when needed.

can a medical assistant be eligible for H1 visa. I have a sponsor but we dont know whether medical assistant job is eligible for a H1 visa. Please let me know if this is possible. I am a medical school graduate. the hospital is a private practice. I am currently on student visa(I-20).

I got my H1B Petition approved and have been working on OPT status since August. I made a Visa appoitment for tommorow and while taking the appointment I chose the Visa Renewal category instead of a new H1B visa.
My interview is tommorow and I am not able to change or cancel the date as in Delhi it needs to be done 2 working days before.
I want to know if anyone has gone though a similar experience and what should I do?

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

I don't believe leaving the company that you had signed an I-9 form with have any impact on your GC app as long as you have a same or a similar job lined up if and when you do get an RFE regarding the same.
As mentioned several times, GC is for future employment and you can switch employers as many times as you want under AC21 (of course you don't want to go overboard with switching employers every few months either :)).
I hope this helps - again this is my understanding of the law and not a legal opinion.

U r absolutely right........ i have heard ppl saying they are willing to transfer H-1B's but they say they wont process GC............. This is just un believable.......... I guess the whole idea is to recycle ppl after every 6 years..........

I recently read somewhere that Infy/wipro although applied for 20K H1 visas only applied for less than 100 GC last year.

Hi folks,
My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?

Joined California based consulting company in mid 2006, got project in Maryland(MD). Worked in Maryland but CA company ran payroll on CA address. I have LCA for Maryland. End of year,2006 filed tax filing with CA state.
Project went till February,2008 they are running my pay stubs,W2 with CA address. I filed CA tax returns for year 2007 but stayed in Maryland.
Now my questions is I�m present in Maryland(LCA) but pay stubs,W2 are showing CA address. In demographic information form(g-325) which I address I need to use. Should I go with physical address(Maryland) or W2 address(CA).
I have no idea how to go about this, can you please advice how to present my case.

Great tip from AILA for our H1B (http://www.h1b.biz/lawyer-attorney-1137085.html) filers trying to beat the rush. Because you cannot submit an LCA earlier than six months prior to the beginning date of the period of intended employment (20 CFR � 655.730(b)), if you want your LCA in hand before April 1, then set your employment start date on the LCA for a date in September, and set the expiration date for a date no more than three years hence. File the I-129 with a start date of October 1, but with an expiration date that coincides with the expiration date of the LCA. You will lose a couple of days on the back end of the petition by doing this, but you will get the LCA filed and back before April 1.
Example:
LCA start date: 9/1/10
LCA end date: 8/31/13
Form I-129 start date: 10/1/10
Form I-129 end date: 8/31/13
Due to delays in receiving approved LCAs, take the proper precautions and file your LCA early to avoid any undue delays.
Although under certain circumstances USCIS has agreed to accept H-1B petitions for processing that include LCAs that have not been certified, attorneys should understand that if the LCA submitted with the H-1B petition is eventually denied, the H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) will be denied, even if a subsequent certified LCA is submitted. My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July.

I always wonder these ARAVAS deserve GC?
Because where ever they will make lot of fuss there and cause so many troubles to hosting country...
Srilanka they made a beautiful country as almost ash because of their perverted intensions..And Singapore they will never go with country's best interests...and Malaysia....
And even in India see the support to LTTE (Openly)
Also all most all these ARAVAs are blue collar cheap labor, I don�t know how a considerable number of Tamils getting h1b
Actually USCIS needs to think about them to avoid future problems...
