Guys,
Does anybody here got a rejection becuase of the incorrect filling fee?
If so can you share the message on the lette which was received along with the rejected application.
I have received a rejection letter for my spouse with the following message in it.
"The above application or petition, along with any check or other form of fee payment, is attached. The application or petition cannot be accepted because the proper fee of $1010.00 U.S is not attached. Since the case is not properly filed, a priority or processing date cannot be assigned.
Please attach a check or money order for this amount and resubmit this entire package to the address listed below. To speed processing, please leave this notice on top."
Can anyone confirm with me if they got the same message for incorrect filing fee? The message is very ambigious if the filling was incorrect or they did not find the filing fee attached with the application.
Please reply to this posting with the message they received for rejection of their application or if anybody has any information on this.

Why don't you go and get the visa stamped in chennai consulate or wherever it is applicable to you.

I have a PD of April 2008 in the EB2-I category, but am exploring the option of switching to EB1 if possible. I am a clinical psychologist, working in a not-for-profit agency. What are my chances? Does it depend more on the case itself or a really good lawyer who can present your case in the best way it can be presented? This is a really stressful situation because my husband's H1-B runs out next summer and we cannot live here on just my income. Any feedback?
I believe the case itself is the major factor. The credentials/publications/patents + solid letters of recomendations etc is the major factor. The attorney can advice you on the types of letters or proofs that are required to substantiate your case but not more. And ofcourse once you have decided that you could potential go for the EB1, I would certainly ask others for attorneys who have had more success in EB1 cases. The "good" attorney will evaluate your total package and asks you for more documents if it is not good enough. Others will take your money and all material you send and just send it over to the CIS.

I've read conflicting information on whether one is eligible to receive unemployment benefits.
Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.
So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

I have been watching IV forum during the last four weeks. I feel it is a great place to post questions and comments to help everybody in our long Immigration journey. I have a situation here.
I have filed my H-1B extension, my wife�s H-4 extension, my I-140 and our I-485 applications recently from my current address. I haven�t got the approvals yet for any of them. I am thinking of taking another project(with the same employer of course) next month and relocating to a new state.
I heard that immigration documents don�t get forwarded by USPS. My worry is about my wife�s H-4 extension approval notice as other communications will go either to my employer or lawyer. I know that we have an online form to update our new address to USCIS.
Did anybody run into problems of mails being sent to the address in the forms even after you filled out this form?
Please let me know what you think about relocation after filing immigration papers.

Call USCIS and verify your address. Have you moved receently - sometimes your AR11 change of address may not have been recorded on your case.

There are some website that help you to prepare tax return, for example Finalysis.com, myIBSN.com.
These guys are filing 2106 form for claiming employee job expenses and Misc deductions and getting more refund.
In my case my offshore company (in India) has office in NY/NJ and I am working in Georgia state and for whole year 2007 i was working in Georgia state and I had never been to NY/NJ.
In this scenario can i claim for rent/meals/commutation/laundry?
There are many applicants filing through these tax preparer's approx 2,50,000 are these agencies reliable?
